ORDER

This Criminal Original Petition has been filed, seeking to modify the order dated 09.03.2026 passed in C.M.P.No.1960 of 2026. By the said order, while returning the petitioner's vehicle being the tipper lorry that was illegally used to transport the minerals, the Court below has imposed one of the

condition to execute an own bond for a sum of Rs.10,00,000/- along with two sureties.

2. The learned counsel appearing for the petitioner would submit that this petition is filed being aggrieved by the condition imposed to execute a bond for a sum of Rs.10,00,000/-. The said sum is onerous and ought not to have been imposed on the petitioner.

3. Upon enquiry, the learned Government Advocate (Criminal Side) would confirm that the vehicle was manufactured of the year 2012.

4. Considering the submission made by the learned Government Advocate (Criminal Side), this Court is inclined to modify the condition that the petitioner shall execute an own bond for a sum of Rs.2,00,000/- instead of Rs.10,00,000/-, along with two sureties.

5. Accordingly, the petitioner shall execute a bond before the Trial Court, for a sum of Rs.2,00,000/- with two sureties for like sum. All other conditions remain the same. In view of the condition being modified by this Court, time is extended for a period of three weeks from the date of receipt of a website uploaded copy of this order, in order to enable the petitioner to comply with all the conditions.

6. With the above directions, this Criminal Original Petition stands disposed of.
