This petition has been filed to modify the condition imposed by this Court directing the petitioner to deposit a sum of Rs.40,000/- (Rupees Forty Thousand only) by way of Demand Draft/RTGS/NEFT to the credit of the District Mineral Foundation Trust concerned, without prejudice to his rights and contentions before the Trial Court.

2. Earlier, this Court granted bail to the petitioner on condition that the petitioner shall make a non-refundable deposit of Rs.40,000/- to the credit of District Mineral Foundation Trust concerned without prejudice to his rights.

3. It is stated by the petitioner that he is unable to make nonrefundable deposit of Rs.40,000/- due to his indigent circumstances and therefore, seeks modification of the condition to reduce the amount to Rs.10,000/-. The learned counsel for the petitioner submits that petitioner is willing to deposit Rs.10,000/- without prejudice to his case.

4. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, this Court is inclined to order the petition as prayed for.

5. The Registry is directed to issue fresh order copy to the parties.
