ORDER

The Writ Petition has been filed for a direction, directing the 2nd respondent to provide police protection to enter into the petitioner's property comprised in New Survey No.36/4B1, Old Survey No.36/4, measuring to an

extent of 2 acres 15 cents situated at Periyasathdai Village, Mettur Taluk, Salem upon considering the representation dated 28.05.2026. 2.On a perusal of the records, it reveals that the petitioner had purchased the subject property comprised in New Survey No.36/4B1, Old Survey No.36/4, measuring to an extent of 2 acres 15 cents situated at Periyasathdai Village, Mettur Taluk, Salem District, through a public auction conducted by the bank. In pursuance of the purchase of the said property, the petitioner was also issued a sales certificate. When that being so, whenever the petitioner entered the property, the original owner of the property objected the same. Therefore, the petitioner lodged a complaint on 28.05.2026. 3.Mr.R.Ganesh Kumar, the learned Government Advocate (Criminal Side) submitted on instructions, that on receipt of the said complaint, the 2nd respondent conducted enquiry and the same was closed, since the entire dispute is civil in nature.

4.When the petitioner had purchased the property in a lawful manner that too through the public auction conducted by the bank and the sales certificate was also issued in his favour, the original owner cannot object the petitioner from entering into the property.

5.In view of the above, the 2nd respondent is directed to conduct a fresh enquiry on the complaint lodged by the petitioner and pass appropriate orders. It is also made clear that if any cognizable offence is made out, the 2nd respondent shall register the F.I.R. and proceed against him in accordance with law.

6.With the above direction, this Writ Petition stands disposed of. No costs.
