ORDER
The present civil miscellaneous petition has been filed seeking to set aside the order dated 08.02.2023 and to consequently restore the petition in CRP.No.1829 of 2017 against the 1st and 3rd respondents.
2. I have heard the learned counsel on either side and I have also gone through the affidavit filed in support of this petition.
3. On a perusal of the materials placed on record, it is seen that, the present miscellaneous petition has been filed along with a petition seeking to condone the delay of 828 days in filing the present set aside petition and the same has been allowed on 08.09.2025, since the 1st and 3rd respondents have not come before this https://www.mhc.tn.gov.in/judis
Court either in person or through counsel to contest the matter in respect of delay in filing this set aside petition, despite service being effected on them. Consequently, the present Civil miscellaneous petition has been numbered and listed today.
4. I am satisfied with the reasons stated in the affidavit filed in support of this petition for not being able to take steps and thereby, I am inclined to allow this petition.
5. Accordingly, this Civil miscellaneous petition is allowed and the order of this Court dated 08.02.2023 made in CRP.No.1829 of 2017, dismissing the said revision against the 1st and 3rd respondents is set aside.
6. Post the main revision in usual course.
