The Criminal Original Petition is filed seeking a direction to transfer the investigation in Crime No.370 of 2024 from the file of the 3rd respondent to the 4th respondent for conducting fair and thorough investigation in Crime No.370 of 2024.

2. Today when the matter was taken up for hearing, the learned Government Advocate (Crl.Side) appearing for the respondents-Police, on instructions, submitted that there is a dispute between the landlord and tenant. The petitioner herein is a tenant under one Elavenil. On the complaint given by the petitioner, the respondent-Police registered a case in Crime No.370 of 2024 for the offences punishable under Sections 380, 427 and 451 IPC against the said Elavenil. After enquiry, the respondentPolice closed the case in Crime No.370 of 2024 since the dispute between the parties is civil in nature and also filed the closure report filed before the Judicial Magistrate Court No.I, Erode. He further submitted that the respondent-Police also sent RCS notice to the 2/4

petitioner through registered post, but he refused to receive the same.

3. Recording the above submission, this Criminal Original Petition is disposed of. It is open to the petitioner to work out his remedy before the Magistrate concerned by way of filing protest petition. 23.06.2025 Index : Yes/No Speaking Order : Yes/No ms To 1.
