This Application has been filed on behalf of the 2nd defendant seeking to condone the delay of 140 days in filing the written statement. 2.In the affidavit filed in support of the Judges Summons, it had been stated that the delay in filing the written statement was only because examination had to be done with respect to the medical issues, the standard medical protocols followed during surgery, post operative care and medical literatures had to be collected and examined. In all these process there has been a delay.

3.Heard the learned counsel for the plaintiff also. 4.Taking into consideration the nature of reasons given, this Application stands allowed. The delay is condoned. The written statement of the 2nd defendant to be taken on record.
