Seeking leave to file a suit in respect of Item B and D of Schedule A and Item 2, 3, 4 and 5 of Schedule B of the property, the applicant/plaintiff has come up with this application.

2. The applicant is the plaintiff in the suit filed for partition. It is the case of the applicant that the suit property in respect of Item B and D of Schedule A and Item 2, 3, 4 and 5 of Schedule B are situated outside the territorial jurisdiction of this Court though the other property is situated within the jurisdiction of this Court. 3.Considering the averments made in the plaint, leave is granted.
