ORDER
The present Writ Petition has been filed seeking a direction to defreeze the petitioner's bank account bearing No.020805006661 maintained with the third respondent/Bank at Siliguri, West Bengal.
2. It is seen that neither the petitioner, nor the third respondent, falls within the territorial jurisdiction of this Court. The writ petition is founded solely based on a communication dated 21.02.2025, received from the third respondent bank, intimating the debit freeze of the petitioner's account.
3. The main contention of the petitioner is that the said freezing was triggered based on a requisition made by the Tamil Nadu Tambaram City Police (CCB), pursuant to a complaint lodged by one Mr.Sai Rajan relating to an alleged internet banking fraud.
4. However, it is not shown that any part of the cause of action has arisen within the State of Tamil Nadu so as to confer jurisdiction under Article 226(2) of the Constitution of India. The petitioner is based in Delhi, and the disputed account is maintained outside this State of Tamil Nadu.
5. In the absence of any connecting factor to the State of Tamil Nadu, other than a general reference to the involvement of the local Police, this Court is of the 2 / 5
considered view that it does not have territorial jurisdiction to entertain the present writ petition.
6. Accordingly, the Writ Petition is dismissed as not maintainable on the ground of lack of territorial jurisdiction. However, the petitioner is at liberty to work out his remedy before the appropriate forum in accordance with law. 17.06.2025 r n s Index : Yes/No Speaking Order : Yes/No 3 / 5
