ORDER

This Civil Revision Petition has been filed seeking for a limited relief. 2.The petitioner seeks for an early disposal of O.S. No.25 of 2025 pending on the file of the District Munsif cum Judicial Magistrate, Madhavaram.

3.Even though the prayer sought for in this petition is for early disposal of the suit, the learned counsel for the petitioner would now submit that the petitioner is satisfied if a direction is issued to the Trial Court to dispose of I.A. No.2 of 2025 in O.S. No.25 of 2025 within a time frame to be fixed by this Court.

4.The main suit has been filed for a permanent injunction to restrain the respondent/defendant from interfering with the peaceful possession and enjoyment of the property by the petitioner/plaintiff. The petitioner claims that the ownership of the suit schedule property was the subject matter of earlier disputes between the petitioner and the respondent and in the earlier round of litigation between the same parties, the petitioner had been declared the absolute owner of the suit schedule property. According to the petitioner, the respondent/defendant is once again attempting to interfere with the peaceful possession and enjoyment of the suit schedule property. 5.This Court is not expressing any opinion on the merits of the petitioner's contentions before this court, but this Court has given due consideration to the earlier round of litigation said to have been taken place between the petitioner and the respondent involving the very same property.

6.Therefore, in the interest of justice, a direction will have to be issued to the Trial Court as requested by the learned counsel for the petitioner to dispose of I.A. No.2 of 2025 within a time frame to be fixed by this Court. 7.Counter has been filed by the respondent/defendant in I.A. No.2 of 2025.

8.For the foregoing reasons, this Civil Revision Petition is disposed of by directing the District Munsif cum Judicial Magistrate, Madhavaram to dispose of I.A. No.2 of 2025 in O.S. No.25 of 2025 within a period of four weeks from the date of receipt of a copy of this order.

9.Since no adverse orders are passed against the respondent, notice to the respondent is dispensed with. No costs.
