Respondents PRAYER:- Habeas Corpus Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Habeas Corpus directing the respondents herein to produce the petitioner's daughter, minor girl P.Santhiya, D/o.Perumal, aged about 15 years, before this Court and hand over her custody to the petitioner.

ORDER

[Order of the Court was made by P.N.PRAKASH, J] On 04.10.2021, we passed the following order: 'This petition has been filed seeking a direction to the respondents herein to produce the petitioner's daughter minor P.Santhiya D/o.Perumal, aged 15 years, before this Court and hand over her custody to the petitioner.

2. It is the case of the petitioner that her daughter P.Santhiya went missing from 29.10.2020 and thereafter, her whereabouts are not known. The petitioner's further grievance is that the police are not taking effective steps to secure her daughter.

3. Today, Mr.D.Mathivanan, Special Sub-Inspector of Police, Nagarasampatty Police Station, is present.

4. On instructions, learned Government Advocate [crl.side] submits that, on a complaint given by the petitioner, a case in Nagarasampatty P.S.Crime No.570 of 2020 for "girl missing" was registered and investigation is in progress.

5. In view of the above, we direct the Deputy Superintendent of Police, Bargur, Krishnagiri District, to monitor the investigation in Nagarasampatty P.S.Crime No.570 of 2020 and keep the petitioner informed of the developments, if any. As and when the detenue is secured, she shall be produced before the Judicial Magistrate, Pochampalli, under intimation to the petitioner. On such production, the learned Magistrate shall pass appropriate orders. Post on 05.10.2021.'

2. Today, when the matter was taken up for hearing, learned counsel for the petitioner and learned Additional Public Prosecutor submitted that the petitioner's daughter Santhiya was secured by the police on 04.10.2021 and was produced before the
