ORDER
The petitioners, who were arrested and remanded to judicial custody on 10.03.2026 for the alleged offence under Sections 5(j)(i) r/w 6 of POCSO Act and Sections 137(2), 351(2) of BNS Act in Crime No.4 of 2026 on the file of the respondent police, seeks bail.
2. The allegation is that the petitioner under the guise of picking up the defacto complainant's daughter, who is an intellectual disabled person aged about16 years, had attempted penetrative sexual assault on her. Hence, this case.
3. The learned counsel appearing for the petitioners submitted that the petitioner is innocent and he has been falsely implicated in this case. He also submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner.
4. The learned Counsel for Government of Tamil Nadu (Crl Side) would submit that the statement recorded from the victim girl under section 183 of BNSS reveals that the petitioner has committed penetrative sexual assault on her. Hence, he opposed for grant of bail to the petitioner.
5. Heard both sides and perused the materials available on record.
6. Considering the facts of the case and nature of offence and the statement recorded from the victim girl under section 183 of BNSS which reveals that the petitioner has committed penetrative sexual assault on the victim girl, this Court is not inclined to grant bail to the petitioner.
