Sasikaran v. The Inspector Of Police

Crl.O.P.No.16578 of 2023 G.CHANDRASEKHARAN.J., The petitioner namely Sasikaran, who was arrested and remanded to judicial custody on 12.06.2023 for the offences punishable under Section 399 of IPC in Crime No.193 of 2023 on the file of the respondent police, seeks bail.

2. This is the second bail petition filed by the petitioner after the dismissal of the bail petition in Crl.O.P.No.14738 of 2023. The said petition was dismissed on 30.06.2023 on the ground that, petitioner has following previous cases:

i)Perambalur PS Cr.No.128/2016 U/s 302 I.P.C @ 120B, 147, 148, 302, 324, 343, 364, 364A, 365 I.P,C.- Acquitted. ii)Perambalur PSCr.No.425/2018 U/s 147, 148, 302 - I.P.C. @ 120B, 147, 148, 302, 323, 34, 365 I.P.C. - Acquitted. iii)Perambalur PS Cr.No.537/2013 U/s 366 (A) - I.P.C @ 366 (A) - I.P.C. 3, 4,-POCSO Act - NTF iv)Padalur PS Cr.NO.72/2017 U/s 151 - CRPC 7 (1) (a) - CLA Act -PT 1/4

v)Mangalemdu PS Cr.No.383/2010 U/s 392-I.P.C. - Acquitted vi)Perambalur PS Cr.NO.694/2018 U/s 294 (b), 341, 392, 397, 502 (2) - I.P.C. - Acquitted vii)Perambalur PS Cr.No.1627/2020 U/s 399 - I.P.C. 25 (1A) - ARMS ACT-PT.

3. It is the further submission of the learned counsel for the petitioner that, out of the 7 previous cases cited above, five previous cases ended in acquittal. Now, there are only two previous cases pending against the petitioner, Hence, he seeks bail to the petitioner,

Though, the learned counsel for the petitioner claims that, petitioner had been acquitted in five previous cases, the fact remains that, petitioner is an accused in the remaining two cases, and those cases are still pending to be disposed. Therefore, there is no change of circumstances warranting this Court to consider the bail petition in favour of the petitioner.
