ORDER

Heard Mr.A.Kaushik Narain Sharma, the learned counsel for the petitioner. No representation for the respondents.

2. The petitioner has filed this writ petition seeking a writ of mandamus to direct the respondents to consider her representation dated 19.08.2021 and direct the first respondent not to disburse any amount until disposal of the said representation.

3. The petitioner is the sister of deceased K.C.Rajendra Kumar who worked as Scientific Assistant and died in harness on 15.05.2021.

4. Mr.A.Kaushik Narain Sharma, the learned counsel for the petitioner, submitted that during the lifetime of K.C.Rajendra Kumar, he has got some matrimonial dispute with his wife and hence he nominated his two children alone to receive his terminal benefits; in fact after the disposal of the matrimonial dispute, the petitioner nominated his two children, father and mother; though, he had altered the nominee particulars

and included the petitioner's name along with the names of his two children, the respondent bank did not disburse the amount to the petitioner as per the nomination.

5. There is no representation for the respondents to offer comments on the submission made by the learned counsel for the petitioner.

6. Considering the limited prayer in this writ petition, the first respondent is directed to consider the representation of the petitioner dated 19.08.2021 on its own merits and in accordance with law and pass orders, within a period of four weeks from the date of receipt of a copy of this order.
