ORDER

This Criminal Original Petition has been filed seeking a direction to the Special Court for trial of SC/ST Cases, Perambalur, to consider the petitioner's bail application sympathetically and pass orders on merits on the same day of his surrender, in connection with Crime No.208 of 2025, pending on the file of the second respondent police.

2. Heard the learned counsel for the petitioner, and the learned Government Advocate (Crl. Side) for the respondents 1 and 2.

3. The learned Government Advocate (Crl. Side) submitted that the petitioner and the de facto complainant are adjacent landowners and there was some property dispute between them. It is alleged that, owing to the said dispute, the petitioner and the other accused persons abused the de facto complainant by using caste-based derogatory remarks. It is further submitted that there are totally fifteen accused in this case and that all the other accused have already been granted bail. The petitioner had been employed abroad and has only recently returned. The investigation has been completed and a final report has been filed, which has been taken on file as Spl.S.C.No.10 of 2026.

4. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in the present case.

In view of the above factual position, there shall be a direction to the Special Court for trial of SC/ST Cases, Perambalur to consider the petitioner's bail application, preferably on the same day of his surrender, in connection with Crime No. 208 of 2025 on the file of the respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioner shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of the receipt of a copy of this order.
