This Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the Respondents herein to Survey the Petitioner's property in RS.SF.45/9 situate at Uratchikottai village, Bhavani, Erode District by considering the Challan dated 22.11.2018 and the Petitioner's representations dated 22.11.2018 and 07.02.2020 submitted to the respondents respectively.

ORDER

This Writ Petition has been filed for the issue of a Writ of Mandamus directing the respondents to consider the representation made by the petitioner on 22.11.2018 and conduct a survey in the subject property.

Mr.E.Balamurugan, learned Special Government Pleader appearing on behalf of the respondents submitted that the first respondent has already called the petitioner for an enquiry on 18.12.2020 at 11.00 a.m. The learned counsel further submitted that the petitioner can be present at the time of enquiry along with all the relevant documents and the first respondent will take a decision with regard to the survey of the subject property.

Taking into consideration the facts and circumstances of the case and also of the fact that the first respondent has already called the parties for enquiry, there shall be a direction to the first respondent to conduct enquiry immediately in accordance with law and complete the process within a period of four weeks from the date of receipt of a copy of this order.

This Writ Petition is disposed of with the above directions. No costs.
