ORDER : The Court Made the following order :- The petitioners, who apprehend arrest for the alleged offence under Sections 147, 353, 307, 430, 379 of IPC r/w Section 21(1) of Mines and Minerals Act in Cr.No.181 of 2021, seek anticipatory bail. 2.The case of the prosecution is that the petitioners attempted to take lake sand by using tractor and tipper which was prevented by the Special Sub-Inspector of Police. At that time, the petitioners attempted to dash the SSI using tractor. Thereafter, the present case was registered by the law enforcing agency.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4.The learned Government Advocate (Crl.Side) submitted that the petitioners are history sheeters. He further submits that earlier this Court had dismissed two anticipatory bail petitions filed by the petitioners and this is the third anticipatory bail petition filed by them. Hence, he vehemently opposed for grant of anticipatory bail to the petitioners.

Considering the gravity of offence committed by the petitioners and the earlier anticipatory bail petitions were dismissed by this Court and there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this criminal original petition is dismissed. -sd/- 05/10/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
