.. Defendant Civil Suit filed under Order IV Rule 1 of Original Side Rules 1956 read with Order VII Rule 1 CPC praying for the following judgment and decree against the defendant for the following reliefs:

a)directing the defendant to pay a sum of Rs.40,32,135/- (Rupees forty lakhs thirty two thousand one hundred and thirty

five only) together with interest at 18% per annum on Rs.33,73,360/- from the date of the plaint till the date of the realisation and b) costs of the suit;

J U D G M E N T

The suit has been laid by the plaintiff for recovery of money from the defendant in respect of the agreement dated 31.08.2010 with reference to display advertisements on Toll Plaza Canopy Fascia at Uthandi.

2.As per the plaintiff's case, it is found that the defendant has to pay the suit amount to the plaintiff and inasmuch as the amount not paid and also the cheque issued by the defendant in favour of the plaintiff has also been returned with an endorsement ''funds insufficient'', it is found that the plaintiff,

after issuing the suit notice, has laid the suit against the defendant for recovery of money.

3.The defendant has been set ex-parte.

4.In support of the plaintiff's case, the plaintiff examined PW1 and the documents Exs.P1 to P14 were marked. 5.Considering the evidence of PW1 and Exs.P1 to P14, they being not controverted in any manner, it is found that the plaintiff has established his case.

6. In the result, the suit is decreed as prayed for with costs.
