Defendant Prayer : This Civil Suit has been filed under Order IV Rule 1 of O.S.Rules r/w Order VII Rule 1 of C.P.C praying for judgment and decree in favour of the plaintiff a) directing the defendant to pay liquidated damages provisionally estimated at Rs.5,00,00,000/- (Rupees Five Crore Only) for the loss of goodwill and reputation of the plaintiffs which was done by false, motivated, defamatory and derogatory acts of defendant with interest @ 12% per annum from the date of plaint till the date of realization; b) for a permanent injunction restraining the defendant, his men, agents, servants, henchmen and anyone claiming under the defendant or any other distributors of the film 'Kadal' from entering, interfering or

trespassing in any manner with the plaintiff's peaceful possession and enjoyment of the suit properties.

c) for a permanent injunction restraining the defendant, his men, agents, servants or any other persons claiming under the defendant or any other distributors of the film 'Kadal' from damaging the goodwill and reputation of the plaintiffs by doing false, motivated, defamatory and derogatory acts and d) direct the defendant to pay the cost of this suit. Learned counsel for the plaintiffs is present.

2. Memo filed by the plaintiffs seeking permission to withdraw the suit enclosing the copy of the letter sent by the plaintiffs to the learned counsel for the plaintiffs. Memo is taken on file.

In the light of the above said memo, the Civil Suit is dismissed as withdrawn. Consequently connected original applications are closed. Registry is directed to verify and refund half of the Court-fee, if it is applicable as per Rules.
