ORDER

The petitioner, who apprehends arrest for the alleged offence under Section 303(2) and 326(a) of BNS, in Crime No.07 of 2026, on the file of the respondent police seeks anticipatory bail.

2. The allegation against the petitioner is that he was involved in the illegal transportation of 1/4 unit of river sand in a bullock cart. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. He further submitted that the petitioner is ready to co-operate for investigation. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner has three previous cases, similar in nature pending against him. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. From the submission made by the learned Government Advocate (Crl.Side), it is seen that the petitioner has three previous cases, similar in nature, which clearly demonstrates that the petitioner has misused the liberty granted by this Court and subverts the course of justice by repeatedly committing the similar offences. Hence, this Court is not inclined to grant

anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
