There is a delay of 523 days in representing the Civil Revision Petition in C.R.P.(NPD).SR.No.53148 of 2014.

2.Though notice was served on the respondent and his name has been printed in the cause list, none appeared on his behalf.

3.In paragraph no.4 of the affidavit filed in support of the petition, the petitioners have stated that the Registry had returned the papers on 10.07.2015 and that after taking return of the papers, the 1st petitioner fell sick and admitted in a hospital and was taking treatment. After recovering from the illness, he took steps to represent the papers and hence, there is a delay of 523 days.

4.Though the petitioner has explained the reasons for the delay in the affidavit filed in support of the petition, since the delay is on the higher side, in the interest of justice, the same can be condoned on payment of costs.

Accordingly, the delay of 523 days in representing the papers is condoned on condition that the petitioners paying a sum of Rs.1,000/- (Rupees one thousand only) to the Hon'ble Chief Justice Relief Fund within two weeks from the date of receipt of a copy of this order, failing which, it is made clear that the petition shall stand dismissed automatically without any further reference to this Court.

5.The petition is ordered.
