ORDER

The present writ petition has been filed to direct the 1st respondent to consider the petitioner's representation dated 30.04.2025 in accordance with Special Rules for Tamil Nadu Municipal Commissioner's Service.

2. The learned counsel for the petitioner would submit that he has submitted a representation to the respondents to appoint him to the post of Selection Grade Municipal Commissioner, temporarily by way of recruitment by transfer under section 17(1) and (4) of the Tamil Nadu Government Servants (Conditions of Service) Act, 2016. The learned counsel would further submit that inspite of his representation dated 30.04.2025, the respondents have not passed any order on his representation.

3. At this juncture, the learned additional Government Pleader would submit that the petitioner is not eligible to be considered for the appointment of post of Selection Grade Municipal Commissioner since there is a disciplinary proceeding pending against him. However, he would fairly submit 2/5

that the representation of the petitioner would be consider within a reasonable time.

4. In such view of the matter, without going into the merits of the case, this Court deems it to appropriate to direct the respondent to consider and pass order upon the representation of the petitioner dated 30.04.2025 on its own merits and in accordance with law within a period of six (6) weeks from the date of receipt of a copy of this order.

5. With the above observations, the Writ Petition stands disposed of. No costs.
