ORDER

The petitioner apprehends arrest for the alleged offence under Sections 420 of Indian Penal Code, 1860 (corresponding 318(4) of BNS) in Crime No.585 of 2025 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that Tata AIG General Insurance Company Limited filed a complaint claiming that a fake insurance policy was

used in a Motor Accident Claims Tribunal case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is neither the owner of the vehicle nor an employee, agent or authorised representative of the insurance company. It is further submitted that he is not engaged in the business of issuing insurance policies and has never represented himself as an insurance provider. He further submitted that he is ready to abide by any conditions that may be imposed by this Court and ready to co-operate with the investigation. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and upon instructions, submitted that the petitioner has got one previous case. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. From the submissions of the learned counsel on either side and considering the facts and circumstances of the case and taking note of the nature of the allegation against the petitioner and the fact that the petitioner has one

previous case, this Court is not inclined to grant anticipatory bail to the petitioner.
