C.M.P.No.14042 of 2025 in C.M.A.S.R.No.85384 of 2025 SATHI KUMAR SUKUMARA KURUP, J.

Learned Counsel for the Petitioner submits that the petition had been filed to condone the delay of 38 days in preferring the Appeal in C.M.A.S.R.No.85384 of 2025.

Also he would submit that the Respondent-1 remained exparte before the trial Court.

2. Learned Counsel for the Respondent2, Mr. K.E.Elangoo present in Court submits that he has no objection in allowing this petition on condition that the interest may be waived for the period of delay.

3. The Civil Miscellaneous Petition is allowed on condition that the Appellant is not entitled to claim interest for the period of delay of 38 days.

4. Accordingly, the C.M.P is allowed.
