Prayer: This writ petition is filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the respondents to pay the petitioners interest for the belated payment of PF, gratuity, earned leave salary and commuted value of pension at the rate of 12 % per annum within a specified time, as may be fixed by this Court. ORDER

The writ petition is filed for the below relief: "directing the respondents to pay the petitioners interest for the belated payment of PF, gratuity, earned leave salary and commuted value of pension at the rate of 12 % per annum."

2. The brief facts which are culminated in the filing of this writ petition are set out below:

2.1. It is the case of the petitioners that they joined the service of the first respondent Corporation and retired from service on attaining the age of superannuation. The respondents settled the PF, Gratuity, Earned Leave Salary and Commuted value of pension with a delay. Therefore, the respondents are

legally bound to pay interest to the petitioners. Therefore, the petitioners made a representations to the respondents to pay the interest at the rate of 12% p.a., for the belated payment of the petitioner's PF, Gratuity, Earned Leave Salary and Commuted value of pension. Since there is no response, the petitioner is before this Court.

3. Heard the learned Counsel on either side and perused the materials available on records.

4. Admittedly, the PF, Gratuity, Earned Leave Salary and Commuted value of pension has been paid belatedly for no fault of the petitioner. Therefore, the petitioner is entitled to interest on the same. Therefore, the Writ petition is disposed of with a direction to the respondents to disburse the 6% interest for belated payment of PF, Gratuity, Earned Leave Salary and Commuted value of pension within a period of one (1) month from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition in W.M.P.No.23293 of 2026 is ordered as prayed for. 15-06-2026 Index: Yes/No Speaking/Non-speaking order rap
