Common Prayer :- Transfer Civil Miscellaneous Petition is filed under Section 24 of the Civil Procedure Code, to withdraw the HMOP pending on the file of the Family Court, Salem in HMOP.No.496 of 2022 and transfer the same to Family Court, Namakkal (or) Sub Court, Kulithalai, Karur District (or) Sub Court, Musiri, Trichy district. COMMON ORDER The parties, being husband and wife, were referred to the Mediation Centre, and they have successfully and amicably resolved all the disputes. A settlement agreement was reached before the Mediation Centre on 29.07.2025. The said settlement agreement is presented before this Court for approval.

2. The petitioner as well as the respondent, along with their respective counsel, have signed the said settlement agreement. The terms of the settlement have also been acted upon and fully complied with.

3. Recording the same, by an order dated 18.08.2025, this Court had directed the Registry to call for the entire records in H.M.O.P.Nos.496 of 2022 and 93 of 2025 from the Family Court, Salem. The records have since been received and are available for perusal.

4. In view of the settlement between the parties, there is nothing 2/5

further to be done. It is unnecessary to drive the parties back to the Family Court to file an application for divorce under Section 13-B of the Hindu Marriage Act on the ground of mutual consent.

5. I have gone through the settlement agreement, and it is a comprehensive settlement. All issues have been fully settled. In the light of the above, since both parties have filed separate O.Ps., seeking divorce, there is no impediment for this Court to record the settlement between the parties and grant dissolution of marriage. The amount of Rs.6,00,000/-, agreed to be paid is paid, has also been acknowledged. The parties appeared before this Court on 04.08.2025 and confirmed that they have voluntarily settled their disputes, without any undue influence from any person whatsoever.

6. In the light of the above, the marriage between the petitioner and the respondent, solemnized on 20.06.2019, is hereby dissolved by mutual consent.

7. Accordingly, these Transfer Civil Miscellaneous Petitions are disposed of. The settlement agreement shall form part and parcel of this order. No costs. Consequently, connected Civil Miscellaneous Petitions are closed.
