Prayer: Writ Petition filed under Article 226 of the Constitution of India, pleased to issue a Writ of Mandamus, directing the 4th respondent to provide adequate police protection for conducting survey by the 2 and 3 respondents in respect of the land comprised in Survey Nos.10/1A and 1/4

10/3C, situated at RC Chettipatti Village, Omalur Taluk, Salem District with metes and bounds and to demarcate boundaries based on the notice for survey issued by 3rd respondent dated 28.04.2023 for survey along with adequate police protection under the supervision of the 4th respondent based on the application of the petitioner within a stipulated time.

ORDER

This writ petition has been filed seeking for a direction to the fourth respondent to provide adequate police protection for conducting survey by the respondents 2 and 3 in respect of the land comprised in Survey Nos.10/1A and 10/3C, situated at RC Chettipatti Village, Omalur Taluk, Salem District with metes and bounds and to demarcate boundaries based on the notice for survey issued by third respondent dated 28.04.2023 for survey along with adequate police protection under the supervision of the fourth respondent based on the application of the petitioner within a stipulated time.

2. Learned Additional Public Prosecutor appearing on behalf of 2/4

respondents 1 to 4 submitted that based on the complaint given by the petitioner, an enquiry is pending in CSR No.368 of 2023 on the file of Omalur Police Station/ fourth respondent.

3. In view of the above, this Court directs the fourth respondent to conduct enquiry in CSR No.368 of 2023 and take a decision on the same as expeditiously as possible.

This Writ Petition is disposed of with the above direction. No costs.
