Aggrieved by the order dated 17.09.2021 passed by the learned Master in A. No.2428 of 2021 in CS Diary No.20472 of 2018, wherein notice was issued to the respondents / defendants returnable by 02.11.2021, this application (A. No.3903 of 2021) has been filed seeking to set aside the order dated 17.09.2021 passed by the learned Master.

2. The learned counsel for the applicant / plaintiff on instructions would now submit that he is withdrawing this application (A No.3903 of 2021), but however, he seeks a direction of this Court to the learned Master to dispose of A No.2428 of 2021, within a time frame to be fixed by this Court.

3. A No.2428 of 2021 has been filed by the plaintiff before the learned Master seeking to condone the delay of 1124 days in representing the Plaint in CS Diary No.20472 of 2018.

4. After recording the submissions made by the learned counsel for 1/3

the applicant / plaintiff, this application viz., A. No.3903 of 2021 is dismissed as withdrawn and this Court directs the learned Master to dispose of A.No.2428 of 2021, within a period of one month from the date of completion of service of notice on the respondents in A. No.2428 of 2021.

5. The applicant / plaintiff is also permitted to serve the notice on the respondents in A. No.2428 of 2021, privately as well as through Court. 08.11.2021 vsi2/ab 2/3
