Mr.C.Thiagarajan for Mr.P.Giridharan J U D G M E N TR.S (Judgment of the Court was made by R.SUBRAMANIAN, J.) Pending appeal, parties have entered into a compromise and a Joint Compromise Memo dated 09.03.2024 signed by the parties and their respective counsels has been placed before us.

2.As per Clause 2 of the Joint Compromise Memo, the defendants in C.S.No.490 of 2019 have handed over a demand draft viz., bearing No.000432 dated 11.03.2024 drawn on HDFC Bank, for a sum of Rs.10,00,000/- (Rupees Ten Lakhs Only) in favour of the plaintiff. The said demand draft is handed over to the learned counsel for the plaintiff and the same is recorded.

3.The Appeal stands disposed of in terms of the Joint Compromise Memo. The Joint Compromise Memo will form part of the decree. No costs. Consequently, connected Civil Miscellaneous Petition is closed.

4.In view of the judgment of the Hon'ble Supreme Court in HIGH COURT OF JUDICATURE AT MADRAS REP. BY ITS REGISTRAR GENERAL VS. M.C.SUBRAMANIAM AND OTHERS [2021 (3) SCC 560] the Court fee paid in the appeal is directed to be refunded to the appellant.
