O R D E R
(Order of the Court was delivered by R.Subbiah,J.) Heard M/s.Radha Gopalan, the learned counsel appearing for the petitioner and Mr.C.T.Ramesh, the learned Additional Government Pleader (Puducherry) for the respondents. This Writ Petition has been filed by the petitioner, seeking to quash the Government Order, passed vide G.O. Ms. No.99 of Chief Secretariat (Education) dated 10.08.2006 and consequently, to direct the respondents to fill up the M.B.B.S. Seats on general merit and without reference to regional reservation.
It is seen that, when the Writ Petition was admitted on 08.09.2009, this Court, taking into consideration of the fact that, the petitioner was provisionally selected and issued with the provisional allotment order, dated 07.09.2009, whereby, she was alloted a seat in Vinayaka Mission's Medical College, Karaikkal, passed an interim direction, and granted liberty to the petitioner to join the M.B.B.S. Course in the said Medical College. When the Writ Petition was taken up for hearing today, the learned counsel appearing for the petitioner has submitted that, pursuant to the said interim order, the petitioner joined the Course and completed the M.B.B.S. Degree. It is further submitted that the Government Order, impugned herein, was put to challenge by similarly aggrieved persons, in W.P.Nos.13130, 13450 of 2010, etc (batch) before the Hon'ble First Bench, and the Hon'ble First Bench, by a common order, dated 06.08.2010, partly allowed the Writ Petitions and quashed the Government Order. For better appreciation, the operative portion of the said order reads as follows:- "
In the result, all the Writ Petitions are partly allowed and the impugned Government Order in G.O.Ms.No.99 dated 10.8.2006 and the Information Bulletin issued by the second respondent as approved in G.O.Ms.No.65 dated 21.5.2010 in so far as it relates to specific regional allocation of seats for Puducherry Region alone is set aside as being violative of Article 14 and 15 of the Constitution of India and in all other respects, the Writ Petitions stand dismissed. "
Thus, in the light of the order passed by the Hon'ble Division Bench, referred to supra, and taking into consideration of the fact that, pursuant to the impugned order, the petitioner
has joined the Course and completed the Degree, nothing survives in this Writ Petition for adjudication. Accordingly, the Writ Petition stands disposed of. No costs.
