ORDER

The petitioners/accused, who are facing trial in Spl.SC.No.26/22 on the file of the learned Sessions Judge, Special Court for trial of Cases registered under SC/ST (POA) Act, Namakkal, have filed this petition to consider their bail application upon surrender.

2. On perusal of records, it is seen that the case was filed in the year 2022. Thereafter, the accused filed discharge petitions, owing to which charges could not be framed and the trial could not progress. The matter was posted for framing of charges on 06.12.2025 and 30.12.2025. However, since the petitioners failed to appear before the Trial Court on 19.01.2026, non-bailable warrants (NBWs) were issued against some of the accused, resulting in further delay in framing charges.

The learned counsel for the petitioners submitted that the petitioners had filed petitions under Section 317 Cr.P.C. seeking exemption from personal appearance, however, the same was dismissed and NBWs were issued. It is further submitted that the petitioners are now ready to appear before the Trial Court, file appropriate petitions for recalling the warrants, and cooperate with the proceedings.

4. Considering the above submissions, this Court directs the petitioners to appear before the Trial Court and file appropriate petitions for recall of the Non-Bailable Warrants. Upon such filing, the Trial Court shall consider and dispose of the same in accordance with law. Thereafter, the Trial Court shall proceed with the case and ensure that the trial is conducted expeditiously without any further delay.

5. With the above directions, this Criminal Original Petition is disposed of.
