ORDER
The petitioner, who was arrested and remanded to judicial custody on 08.05.2026 for the offence punishable under Section 465, 467, 468, 471 and 420 of IPC in crime No.5 of 2026 on the file of the respondent police, seek bail.
2. The case of the prosecution is that the petitioner along with others have created fabricated documents such as fake death certificate and fake legalheirship certificate of one Muniyammal, who is the grandmother of the defacto complainant and executed a sale deed in favour of A1 and the said land was further sold to A5, which led to the registration of an FIR. Hence, the present petition has been filed by the petitioner for seeking bail.

The learned counsel appearing for the petitioners submits that the petitioner is an innocent, he has not committed any such offence as alleged by the prosecution and a false case has been foisted against him. He further submits that the petitioner is in judicial custody from 08.05.2026 and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner.
4.The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that A1 to A5 have colluded together and created fabricated documents such as fake death certificate and fake legal heir certificate of one Muniyammal, who is the grand mother of defacto complainant and that the accused has conspired and A2 and others had executed a sale deed in Doc.No.70/2022 on 08.06.2022 in favour of A1 and revenue documents were also transferred in the name of A1 and further, a petition was filed before Revenue Authorities and Officials and since no actions taken, a Writ Petition in W.P.No.
11959 of 2024 was filed before this Court and this Court has directed the revenue officials to conduct inspection and further based on inspection and investigation, the patta was transferred to Muniyammal and later even in the village panchayat, the accused admitted and accepted to give possession of the said land, but possession was not given and in the year 2024, the petitioner had filed a suit before Principal Sub Court, Dharmapuri in OS.No.267 of 2024 for declaration and injunction. Therefore, the defacto complainant did not lodge any complaint, because of undertaking given by the petitioner, but subsequently, he lodged a complaint, following which, the petitioner was arrested and remanded to judicial custody. Hence, he vehemently opposed to grant bail to the petitioners.
5. Heard the learned counsel for the petitioner as well as the learned Government Advocate (Crl.Side) and perused the materials available on records.
6. Considering the overall facts and circumstances of the case, the petitioners and other have committed serious offence and if the petitioner is released on bail, he will indulge in similar kind of offences. Hence, this Court is not inclined to grant bail to the petitioner.
