PRAYER:

Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus to direct the 3rd and 5th respondents to consider the representation dated 07.04.2018 respectively and direct the 3rd and 5th respondents to remove the obstructions and erections made therein and restore the common area to its original position.

ORDER

Heard the learned counsel for the petitioner, learned Government Advocate for the respondents 1 and 2, the learned Standing Counsels for the respondents 3 to 6. Despite service of notice and name of the 6th and 7th respondents are printed in the cause list, none represents for them.

2. This writ petition has been filed for issuance of a writ of mandamus to direct the respondents 3 and 5 to consider the representation of the petitioner dated 07.04.2018 and remove the obstructions made by the private respondents.

3. The learned counsel for the petitioner submitted that it would suffice, if a direction is issued to the fifth respondent to consider the representation of the petitioner.

4. The learned Standing Counsels for the respondents submitted that the representation of the petitioner would be considered in accordance with law.

5. In the light of the above submissions and also considering the nature of prayer sought for in the writ petition, this Court without going into the merits of the case, directs the fifth respondent to consider the representation of the petitioner and pass appropriate orders on merits and in accordance with law, after providing an opportunity of hearing to the necessary parties, within a period of four weeks from the date of receipt of a copy of this order.

6. With the above direction, the writ petition is disposed of. No costs.
