Crime No.533/2025 ..Respondent(s) PRAYER: The Criminal Miscellaneous Petition has been filed under Section 528 of Cr.P.C. to modify the condition of the petitioner is directed to make non refundable deposit of Rs.1,30,000/- [Rupees one lakh thirty Thousand only directly to the credit of Tamil Nadu State Legal Services Authority, High Court Campus, Chennai imposed by this Honble Court in Crl.O.P.No.8360 of 2026 dated 20.04.2026.

ORDER

This petition has been filed to relax the condition imposed in

Crl.O.P.No.11627 of 2026 dated 08.05.2026 directing the Petitioner to report before the respondent police daily at 10.30 a.m. until further orders.

2. The learned counsel for the petitioner would submit that the vehicle involved in this case is one Tipper Lorry and the petitioner is only a driver and he has no previous cases and he finds difficult to mobilize the fund and hence the condition to deposit a sum of Rs.1,30,000/- may be modified.

3. The learned Government Advocate appearing for the respondent Police objected the application and would submit that 3 units of gravel sand were illegally transported.

4. From the submissions made on either side and considering the fact that the petitioner has no previous cases, this Court is inclined to modify the condition imposed vide order Crl.O.P.No.11627 of 2026 dated 08.05.2026. Accordingly, the condition that "the petitioner shall make a non-refundable deposit of Rs.1,30,000//- to the credit of Tamil Nadu State Legal Services Authority, High Court Campus, Chennai" is modified to the effect that "the petitioner shall make a non-refundable deposit of Rs.50,000/- (Rupees Fifty Thousand only) to the credit of Tamil Nadu Legal Services Authority, High Court Campus, Chennai". The other conditions imposed earlier shall remain unaltered.

5. Accordingly, this criminal miscellaneous petition is ordered. 18-06-2026 MJS Note:
