O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Section 318(4) & 3(5) of BNS Act, 2023 (Sec 420 & 34 of IPC) in Crime No.0134 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that he joined hands with other accused promised the defacto complainant to get government job and collected a sum of Rs.23,29,300/- from the defacto complainant and thereby cheated him. Hence, the case has been registered.

3. The learned counsel for the petitioner submitted that though the petitioners name is mentioned in the FIR, he had no role in collecting money from the defacto complainant. He further submitted that the entire amount collected from the defacto complainant has been handed over to one Sundaramoorthy (A1) in this case. Hence, he prays to grant anticipatory bail to the petitioner.

Per contra, the learned Public Prosecutor (Puducherry) for the respondent reported that they have conducted investigation and it reveals that the petitioner herein was also received more than Rs.10 lakh through Google pay from the said Sundara moorthy. He further submitted that in this regard investigation is also going on. Hence, he oppose to grant anticipatory bail to the petitioner.

5. Considering the above facts and circumstances of the case, the nature of allegation, investigation of this case is pending, and taking note of the fact that the petitioner is also benefited from the amount received from the defacto 2/4

complainant, this Court is not inclined to grant anticipatory bail to the petitioner.
