Respondents - - - - - The learned counsel for the petitioners on instructions has made an endorsement in the Court bundle withdrawing this petition. However, he seeks liberty for the petitioner to file an application under Section 16 of the Arbitration and Conciliation Act, 1996 before the Arbitrator raising the very same grounds that have been raised in this petition.
2. No prejudice would be caused, if such a liberty is granted.
3. The learned counsel for the respondents has also not raised any serious objections, if such a liberty is granted to the petitioners.
4. After recording the endorsement made by the learned counsel for the petitioners, this petition is dismissed as withdrawn. However,
liberty is granted to file an application under Section 16 of the Arbitration and Conciliation Act, 1996 before the Arbitrator raising the very same contentions that have been raised in this petition and the Arbitrator shall decide the same on merits and in accordance with law. 07.09.2023
