This Criminal Original Petition has been filed by the petitioner/A1, who was arrested and remanded to judicial custody on 06.05.2024, seeking bail in Crime No.412 of 2024 for the alleged offences punishable under Sections 395 & 397 of IPC.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner has been suffering incarceration from 06.05.2024 and he is ready to abide by any stringent conditions that may be imposed by this Court, hence, he prayed for bail.

3. Learned Government Advocate (Crl.Side) appearing for the respondent police objected for granting bail to the petitioner stating that the accused had robbed a nose ring, silver chain, two mobiles phones and a bike from the de facto complainant and his girl friend, at knife point. He further submitted that there are six accused in this case and the petitioner is arrayed as A1. He also submitted that, the investigation in this case is not yet completed and no recovery was made from the accused. https://www.mhc.tn.gov.in/judis

4. He further submitted that, several previous cases are pending against the petitioner and the Goondas proposal has also initiated against him, therefore, if the petitioner is released on bail at this stage, there is every possibility of him absconding and would threaten the witnesses.

5. Taking into consideration the facts and the submissions made by the learned Government Advocate (Criminal Side) that the investigation is at initial stage and also considering the conduct of the petitioner, this Court is not inclined to grant bail to the petitioner.
