ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

2. The present writ petition is filed praying for a writ of mandamus to direct the respondents herein to consider the petitioner's representation dated 25.09.2024 whereby the petitioner requested for transfer of patta in his name vide application dated 01.04.2024.

It is submitted by the learned counsel for petitioner that originally the property comprised in Survey No.160/2, Sathya Vijayanagaram Revenue Village, Arani Taluk measuring 0.4.5 hectares (11 cents) recorded in Patta No.2 was owned by the petitioner's father. After the demise of petitioner's father, property was enjoyed jointly by petitioner and two brothers Mannu and Subramanian. It is stated that Mannu passed away on 23.08.2022 leaving behind his legal representatives. It is further submitted that the legal representatives of the deceased brother executed a registered sale deed in favour of the petitioner on 28.03.2024 registered as Document No.3223 of 2024 before the office of SRO, Arani. The petitioner submitted a patta transfer application on 01.04.2024. The same is stated to be pending till date. Aggrieved, petitioner has filed this writ 2/5

petition.

4. Mr.S.Balamurugan, learned Government Advocate appearing for respondents would submit that the representation made by the petitioner would be considered and appropriate orders would be passed within the time period to be fixed by this Court. Agreed to by the learned counsel for petitioner.

5. In view thereof, the writ petition stands disposed of with a direction to the appropriate respondent to consider the representation on its own merits and pass appropriate orders in accordance with law, after affording reasonable opportunity of hearing to the petitioner and any other interested persons/stake holders within a period of 8 weeks from the date of uploading of web copy without waiting for receipt of certified copy. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the concerned respondent to consider the representation on its own merits and in accordance with law. No costs.
