36 of 2013 on the file of Additional District and Sessions Judge, Hosur in CC 88/2004 DMcum-JM, Denkanikottai and pending disposal of Criminal Revision Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl.RC.No.6006/2018 on the file of the High Court and upon hearing the arguments of M/S.MUKUND R.PANDIYAN, Advocate for the petitioner and of MR.SURYA PRAKASH, Government Advocate (Crl.
sentenced to undergo Simple Imprisonment for the period of six months and to pay a fine of Rs.5,000/- in default Simple Imprisonment for one month under Section 255(2) Cr.P.C. Challenging the said order of conviction and sentence, pending revision, the petitioner has filed the present petition.
2. Considering the fact that there are arguable points in the revision and taking into consideration, the facts and circumstances of the case and taking note of the fact that the petitioners have paid the fine amount imposed by the Trial Court, this Court is inclined to suspend the sentence imposed on the petitioners/accused.
3. Accordingly, sentence of imprisonment alone is suspended and the petitioners shall be released on bail on their executing a bond for a sum of Rs.10,000/- with two sureties each for a likesum to the satisfaction of the trial Court on a further condition that the petitioners shall report before the trial Court on the first working day of every month at 10.30 a.m., pending disposal of the revision.
