2026 by the 4th respondent and the installation and the erection of Triple Pole structure, Transmission Towers and 230/33KV DC Transmission lines at the Survey No.80B1B situated at Lakumanaickenpati Village, Kangeyam Taluk, Tiruppur District vide G.O. (4D) No.41 Water Resources (R2) Department, Government of Tamil Nadu on the basis of G.O.Ms.No.101 Water Resources (R2) Department, dated 30.09.2024 and by considering the representations to the 1st respondent dated 02.02.2026, 25.02.2026, 09.04.2026 & 20.04.2026 preferred by the petitioner.

ORDER

The Writ Petition has been filed for a direction, directing the respondents 1 to 3 herein to provide adequate police protection to the life and limb of the staff, contractors, agents of the petitioners company for the erection of 33KV

electric poles and stringing of 33KV overhead transmission lines through the Government Poramboke Lands comprised in Survey Nos. 1080, 1094, 1095, 1112, 1132, 1139, 1140B, 1198, 1200/2, 1207/1, 1212/2, 1217, 1221 and 1242 situated at Vellakovil village and Survey Nos.24, 31, 37, 61, 66, 69, 90 and 95 situated at Lakumanaikenpatti Village, Kangeyam Taluk, Tiruppur district as per order passed under section 16(1) of the Indian Telegraph Act 1885 vide proceeding bearing Na.Ka.No.25632/2025/E5 dated 02.01.2026 by the 4th respondent and the installation and the erection of Triple Pole structure, Transmission Towers and 230/33KV DC Transmission lines at the Survey No.80B1B situated at Lakumanaickenpati Village, Kangeyam Taluk, Tiruppur District vide G.O. 2.The petitioner is engaged in the generation of transmission of electricity through non-conventional electricity generation power projects and setting up renewable energy power projects across India. The petitioner secured a Grant of connectivity for 150 MW at Karur Pooling Station from Central Transmission Utility of India Ltd. dated 16.05.2025. Accordingly, the petitioner signed Memorandum of Understanding (MoU) dated 04.08.2025 with the

Government of Tamil Nadu to set up a wind energy projects for 180 MW in Dindigul, Karur and Tiruppur Districts of Tamil Nadu. The petitioner also obtained prior approval under Section 68(1) of Electricity Act, 2003, from the Ministry of Power, Government of India vide notification bearing No.2517/42/2026-POWER GRID (MoP) dated 02.03.2026 for the construction of 33KV overhead transmission lines included in the transmission system for providing connectivity to its 205 MW Hybrid (Solar: 65MW & Wind: 150 MW) Power Projects in Dindigul and Tiruppur District, Tamil Nadu. 3.That apart, the petitioner also obtained permission from the 4th respondent for stringing of transmission overhead lines through the "Government Poramboke Lands" comprised in Survey Nos.

1080, 1094, 1095, 1112, 1132, 1139, 1140B, 1198, 1200/2, 1207/1, 1212/2, 1217, 1221 and 1242 situated at Vellakovil village and Survey Nos.24, 31, 37, 61, 66, 69, 90 and 95 situated at Lakumanaikenpatti Village, Kangeyam Taluk, Tiruppur District, dated 02.01.2026, as contemplated under Section 16(1) of Indian Telegraph Act, 1885. That apart, the petitioner also obtained permission vide G.O.Ms.No.101 Water Resources (R2) Department, dated 30.09.2024, from the Water Resources (R2) Department, Government of Tamilnadu for installation and erection of Triple Pole Structure, Transmission Towers and 230/33KV DC transmission lines at the Survey No.80B1B situated at Lakumanaickenpatti Vilage, Kangeyam Taluk, Tiruppur District.

4.However, in order to complete the project, while erecting 33KV electric poles and overhead lines at the Vellakovil Village, third parties are objecting from Kangeyam Taluk , Tiruppur District. Therefore, the petitioner lodged a complaint before the respondents 1 to 3 herein, seeking adequate police protection while erecting electric poles and overhead transmission lines.

In view of the above, the 3rd respondent is hereby directed to forthwith provide adequate police protection to the life and limb of the staff, contractors, agents of the petitioners company for the erection of 33KV electric poles and stringing of 33KV overhead transmission lines through the Government Poramboke Lands comprised in Survey Nos. 1080, 1094, 1095, 1112, 1132, 1139, 1140B, 1198, 1200/2, 1207/1, 1212/2, 1217, 1221 and 1242 situated at Vellakovil village and Survey Nos.24, 31, 37, 61, 66, 69, 90 and 95 situated at Lakumanaikenpatti Village, Kangeyam Taluk, Tiruppur district as per order passed under section 16(1) of the Indian Telegraph Act 1885 vide proceeding bearing Na.Ka.No.25632/2025/E5 dated 02.01.
