Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 3rd respondent herein to release the entire employee provident fund amount due to the petitioner within a time frame fixed by this Court. 1/5

ORDER

This Writ Petition has been filed for a direction, directing the third respondent to release the entire employee provident fund to the petitioner.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner had appointed as Salesman in the third respondent Society and retired from service on 30.04.2020. The petitioner was paid certain benefits to his retirement and there is due with the third respondent. Therefore, the petitioner submitted a representation.

4. A perusal of the counter filed by the second respondent reveals that the petitioner is eligible to get the retirement benefits, such as Provident Fund to the tune of Rs.8,21,878/-, Encashment of Leave salary of Rs.2,56,984/-, Security Deposit of Rs.500/- and Gratuity of Rs.8,45,710/-. The petitioner was disbursed with Provident Fund on 2/5

30.04.2020 and Encashment of Leave and Gratuity has been disbursed by the third respondent. On receipt of the representation from the petitioner, it was forwarded to the Deputy Registrar of Cooperative Societies, Cuddalore and thereafter, the third respondent was directed to disburse the Gratuity to the petitioner.

5. In view of the above, the third respondent is directed to disburse the retirement benefits to the petitioner forthwith, if not already disbursed.
