ORDER
This writ petition has been filed for the following relief: "To call for the records relating to the impugned order passed in Na.Ka.No.10919/2024/A2dated 31.03.2026 on the file of the 1st respondent quash the same and direct the 1st respondent to take immediate action against the respondents 3 to 5 be taken by placing
under suspension, following the departmental proceedings who have issued illegal/bogus patta." 2.
The petitioner claims ownership and possession of 2.14 acres of land in S.No.664/3A, South Avinashipalayam Village. He alleges that certain third parties illegally obtained patta in their names with the help of revenue officials, without issuing notice to him or conducting the enquiry as contemplated under the Tamil Nadu Patta Passbook Act and Rules. Aggrieved by the issuance of patta, the petitioner sought information under the Right to Information Act, filed a statutory appeal and also approached this Court in W.P.No.32259 of 2025. As no action was taken despite the directions issued by this Court on 04.09.
2025 in W.P.No.32259 of 2025, he initiated contempt proceedings in Cont.P.No.996 of 2026. During the pendency of the contempt petition, the first respondent had passed the impugned order dated 31.03.2026. Challenging the said order, the present writ petition has been filed.
3. Heard the learned counsels on both sides and perused the materials available on record.

Admittedly, the impugned order has been passed without giving a proper opportunity to the petitioner and also appears to have been passed to get over the contempt proceedings that had been initiated against the first respondent. This fact has also been noted by this Court in its order dated 01.04.2026 in Cont.P.No.996 of 2026.
5. In view of the above, the writ petition is allowed and the impugned order dated 31.03.2026 is set aside. The matter is remitted back to the first respondent for fresh consideration, who shall issue notice to the petitioner as well as respondents 3 to 5, afford them an opportunity to submit their explanations, and thereafter pass orders within a period of two months from the date of receipt of a copy of this order. No costs. Consequently, the connected miscellaneous petition is closed.
