ORDER
The petitioner, who was arrested and remanded to judicial custody on 24.04.2025 for the offences punishable under Sections 406, 465, 468, 405, 471, 477, 420, 120(B), 34 of IPC in Crime No.05 of 2025, on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the petitioner along with other accused represented that they are running Good Luck real estate and offered to purchase land at Perungavur village. The de-facto complainant purchased a plot for a sale consideration of Rs.5,76,000/-. Later, when the de-facto complainant tried to sell the land, she came to know that the land is a Government poramboke land. Hence, the accused persons have cheated many persons to the tune of Rs.54,48,000/-. Hence, the case.
3. The learned counsel for the petitioner submitted that in this case A1 is the person, who executed sale deed to various persons and now that 2/5
place found to be a Government Poramboke land and hence all have lodged a complaint. The petitioner no way involved in the sale of the land by A1. Further in this case A2, A5 and A6 were granted bail. Hence, prayed for granting bail to the petitioner.
4.The learned Additional Public Prosecutor strongly opposed for granting bail to the petitioner stating that the petitioner is the genesis of the entire case. The petitioner projected the Government Poramboke land as his own and executed power of attorney in favour of A1 and A2 is the mediator between the petitioner and A1 with regard to A1 to act as Power of Attorney. Thereafter A1 in a clever manner executed a sale deed to 10 persons giving plot no and different survey number. Later it was found that plots which have been sold to the purchaser is a Government Poramboke land and they have cheated and collected a sum of Rs.54,48,000/- as sale amount. A5 and A6 relatives of petitioner/A3 had mediated for the sale of the lands. The 3/5
petitioner cheated 10 persons to the tune of Rs.54,48,000/-. Hence, strongly opposed for granting bail to the petitioner.
5.Finding the seriousness of offence that the petitioner made arrangements and in a well-planned manner executed sale deed through A1 for a Government Poramboke land and cheated 10 persons to the tune of Rs.54,48,000/-, this Court is not inclined to entertain this bail petition and the same is dismissed.
