The petitioner namely Murugan @ Gana Murugan, who was arrested and remanded to judicial custody on 21.06.2023 for the offences punishable under Sections 4(1)(a), 4(1-A)(ii) of Tamil Nadu Prohibition Act in Crime No.173 of 2022 on the file of the respondent police, seeks bail.

2. The learned counsel for the petitioner submitted that, petitioner is falsely implicated as an accused in Crime No.173 of 2022 for the offences Sections 4(1)(a), 4(1-A)(ii) of Tamil Nadu Prohibition Act. Petitioner is in judicial custody from 21.06.2023. Thus, he prays for grant of bail.

3. The learned Government Advocate (Crl. Side), opposes this petition, on the ground that, petitioner was found with illegal possession of 180 ml Monitor Brandy 28 bottles, XXX Rum 12 bottles and 5 litres of I.D.Arrack, at about 11.30 hours on 15.08.2022. Petitioner has 18 previous cases pending against him, out of which, three are similar cases. Therefore, he strongly opposed this petition.

4. Considering the fact that, petitioner has 3 similar cases and it appears that, petitioner is a habitual offender, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
