ORDER
This petition has been filed to modify the condition imposed in Crl.O.P.No.27807 of 2024 dated 12.12.2024 directing the Petitioner to surrender his passport before the trial court.
2. The learned counsel for the petitioner submitted that he is suffering from Chronic Renal Failure and he has to travel to abroad for his treatment. Hence he needs his passport, which he has surrendered before the trial Court, as per the order of this Court and he finds difficult to appear before the respondent police twice in a week and the said conditions may be modified.
3. The learned Government Advocate appearing for the respondent Police has strongly objected for modification stating that the petitioner was secured only after issuing look out circular and hence, if the condition is relaxed, he would flee.
4. This is a case where the petitioner was secured with great difficulty, that too after issuing Look Out Circular. Considering the past conduct of the petitioner, it is not desirable to modify the condition and therefore, this Court is not inclined to modify the conditions.
5. Accordingly, this Criminal Miscellaneous Petition is dismissed. 17-06-2026 MJS
