2. Learned counsel for the applicant submitted that respondents 1 and 2 are trying to alienate the schedule mentioned properties to third parties with a view to defeat the claim of the applicants herein.

In view of the emerging situation, the notice to the third respondent to file the above suit under Section 80(1) of C.P.C may be dispensed with.

3. Considering the above submission made by the learned counsel for the applicant and the averments made in the plaint, this application is allowed.
