ORDER
The petitioner, who was arrested and remanded to judicial custody on 08.05.2026 for the alleged offences under Section 376(3) of IPC and Sections 5(l) and 6(1) of the POCSO Act in Cr. No.26 of 2026 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner, aged 21 years, had committed aggravated penetrative sexual assault on the minor victim girl, aged 16 years and the victim became pregnant and hence the case.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent and he has been remanded to judicial custody on 08.05.2026. The learned counsel would further submit that false complaint has been lodged against the petitioner and he is ready to abide by any condition that may be imposed by this Court and hence prayed to enlarge the petitioner on bail.
4. At this juncture, the learned Government Advocate (Criminal side) appearing for the respondent police would submit that the statement of the victim girl is yet to be recorded and investigation is pending and therefore, strongly objected to enlarge the petitioner on bail.
5. Taking into account of the pendency of investigation and the seriousness of allegations against the petitioner, this Court is of the firm view that it is not an appropriate stage to enlarge the petitioner on bail.
6. Accordingly, this Criminal Original Petition is dismissed. 12-06-2026 MJS Note:
