When the present Civil Suit is taken up for hearing, the parties, along with their respective learned counsels, are present before this Court, but the second defendant appeared through video-conference. Both parties have produced Joint Memorandum of Compromise, signed by the respective learned counsels and by both parties. It is clear from the joint Memorandum of Compromise that the dispute between the parties, had been amicably settled. The defendants have paid money to the plaintiff to the tune of Rs.4,50,00,000/- (Rupees four crores and fifty lakhs only), of which, Rs.50,00,000/- (Rupees fifty lakhs only) was paid under tri-partite agreement, dated 01.06.2022 and Rs.4,00,00,000/- (Rupees four crores) was paid by way of Demand Draft in No.961302, dated 29.10.2025, drawn on Yes Bank, Indira Nagar, Chennai.
Thus, it is clear from the terms of the joint memorandum of compromise between the parties that the entire amount had been settled to the plaintiff and therefore, both parties settled the matter amicably. In view of the same, this Court, while recording the terms of the joint Memorandum of Compromise, closes the present suit. The plaintiff-Company is entitled to refund of Court fee as per the relevant Rules of this Court, in force. The amount, if any, already deposited by the defendants 1 and 2, during the pendency of the present suit, shall be refunded to the defendants 1 and 2. The joint Memorandum of Compromise shall form part of the decree.
