Today, this matter was listed under the caption "For Being Mentioned" at the instance of the learned counsel for the petitoner, seeking correction in the order dated 08.09.2022.
2. When the matter was called, the learned counsel for the petitioner submitted that in paragraph No.3, the suit filed by the third respondent is typed as dismissed, whereas the same is 'decreed'. Further, the learned counsel for the third respondent with regard to paragraph No.4, submitted that the complaint made before the District Registrar/first respondent is perfectly in order and the same may not be interfered with.
3. Considering the submissions of the learned counsel for the either side, Paragraph Nos. 3 and 4 of the 08.09.2022 are to be read as follows: "3. Learned counsel for the petitioner submitted that for the very same issue, the third respondent already filed a suit as stated above and the same was decreed. The petitioner has also filed a suit for declaration and injunction in respect of the suit property before the sub Court, Arakonam in O.S.No.236/2021 and the same is pending. When the suit is pending before the 1/3
competent civil Court, the complaint filed by the 3rd respondent is not at all maintainable and the impugned enquiry notice issued by the first respondent is also liable to be set aside.
4. Learned counsel for the 3rd respondent submitted that the complaint made before the first respondent is perfectly in order and the same may not be interfered with. However, this Court may grant liberty to the third respondent to present decree for registration before the concerned jurisdiction Sub Registrar."
4. The Registry is directed to make necessary corrections in the said order and issue fresh copies.
