The plaintiffs have presented this application to bring on record the legal heirs of the deceased first defendant. At the last hearing, it was noticed that all the respondents except the sixth respondent were served. At the hearing today, learned counsel for the applicants has placed on record the affidavit of service enclosing the track consignment report, which evidences receipt of notice by the sixth respondent. In spite of service of notice, none of the proposed respondents have appeared either in person or through counsel.
2. Along with the affidavit in support of this application, the applicants have enclosed the death certificate and provided details of the legal heirs of the first defendant. Since the first defendant was not survived by any class I legal heirs, the class II legal heirs are proposed to be impleaded.

3. In the circumstances, this application is liable to be and is hereby allowed. Consequently, respondents 3, 4, 5, 6, 7 and 8 are impleaded as defendants 4 to 9 in the suit. The plaintiffs are directed to carry out the consequential amendments in the plaint on or before 10.01.2023. Upon carrying out such amendments, a copy of the amended plaint shall be served on the other parties within a week.
4. List the matter on 20.01.2023.
