Today the matter has been listed under the caption "for being mentioned" at the instance of the learned counsel for the applicant indicating that even though the judges summons indicate to allow the amendment by adding Para 40A and by substituting Para 41, 43 and 44 of the plaint, the para No.44 is only continuation of para No.43 and para No.44 is the prayer portion and therefore would seek to add para No.40A and substitute Para Nos.41 and 43 alone.

2. Recording the same, in the order dated 05.08.2025, para No.9, last five lines from the bottom, the sentence starting "Presently, the applicants... " shall stand modified as follows:-

9. ..... Presently, the applicants seek to amend the pleadings in the suit by introducing para 40A and by substituting para 41 and 43 of the plaint. ....
